These Terms of Service (the “Terms”) set the ground rules for browsing rialess.us and buying from Rialess LLC, which trades as Rialess (“Rialess”, “we”, “us”). By using the website, creating an account or placing an order, you agree to these Terms and to the policies they refer to. If you do not agree with them, please do not use the website.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to place an order. The details you give us must be accurate, current and complete. If you create an account, you are responsible for keeping your login details safe and for everything that happens under your account, so please tell us promptly if you suspect unauthorized use. We may limit access to the website where that is reasonably needed to protect the site, our customers or Rialess.

2. Our products

Rialess sells women’s leather jackets to customers in the United States. We work hard to show colors, sizes, materials and other specifications accurately, but screen settings, lighting and photography can make an item look slightly different in person. Leather is a natural material, so its grain, shade and texture vary from one jacket to the next. That variation is normal and is not a defect. Stock levels can change without notice, and we may limit the quantity of an item you can buy where the law allows.

3. Placing an order

Submitting an order is an offer to buy. The automatic email you receive straight afterwards only confirms that we got your order. A binding sale exists once we confirm your payment and send you an order confirmation. We may decline or cancel an order because an item is unavailable, a price or product detail is obviously wrong, payment fails, we cannot verify your information, we suspect fraud, or the law requires it. If we cancel an order after taking payment, we refund the full amount to your original payment method.

4. Prices and payment

All prices are shown and charged in U.S. dollars (USD). The final total, including any applicable sales tax, is displayed before you submit your order, and standard shipping within the United States is free. We accept PayPal and major credit and debit cards (American Express, Discover, Mastercard and Visa), processed securely by third-party payment partners. Rialess does not receive or store full card numbers. By paying, you confirm that you are authorized to use the payment method you provide.

5. Shipping and delivery

We deliver only to addresses in the United States. Handling times, transit estimates, carriers and tracking are described in our Shipping Policy, which forms part of these Terms. Delivery dates are estimates unless we expressly state otherwise. If we cannot ship within the time we have stated, or within the period the law requires when no time is stated, we will notify you and offer any cancellation or refund option the law requires.

6. Returns and refunds

You can return most items within 30 days of receiving your order, and we provide a prepaid return label. The full process, conditions and refund timing are set out in our Return and Refund Policy. Nothing in these Terms limits a consumer right that cannot legally be waived.

7. Website content and intellectual property

The text, photographs, graphics, logos and layout on this website belong to Rialess or are used with permission, and they are protected by intellectual-property laws. You may use them for personal, non-commercial shopping only. Please do not copy, republish, distribute, modify, scrape or commercially exploit our content without written permission.

8. Reviews and submissions

If you send us a review, comment, idea or other feedback, you confirm that it is truthful, lawful and does not infringe anyone else’s rights. You give Rialess a non-exclusive, worldwide, royalty-free license to display, reproduce, adapt and use it to run, improve and promote the business. We may remove or moderate content that is unlawful, deceptive, abusive, infringing or unrelated to our products.

9. Acceptable use

Use the website for lawful purposes only. You must not introduce malware, interfere with the site’s security or operation, attempt to gain unauthorized access, harvest other people’s personal information, place fraudulent orders, impersonate anyone, violate others’ intellectual-property, privacy or other rights, post unlawful or malicious content, or use automated tools to scrape or overload the site.

10. Third-party services and links

Our store runs on WordPress and WooCommerce and depends on providers for hosting, security, analytics, advertising, email, payments and shipping. Those providers may process information or supply features the store needs, and their own terms and privacy notices can apply to their services. The website may also link to outside sites such as PayPal or carrier tracking pages. We do not control those sites, and a link is not an endorsement of everything they say or do.

11. Errors and corrections

Product descriptions, availability, prices, promotions or shipping details may occasionally contain a mistake or omission. We may correct them at any time where the law allows. If a material correction affects an order you have already submitted, we will contact you so you can either accept the corrected details or cancel for a full refund.

12. Disclaimers

Apart from the express promises in our policies and any consumer rights that cannot be excluded by law, the website is provided on an “as available” basis. We do not promise that it will always be uninterrupted, secure or free of errors, or that every error will be fixed immediately.

13. Limitation of liability

To the fullest extent permitted by law, Rialess is not liable for indirect, incidental, special, exemplary or consequential damages arising from your use of the website or a product. Where liability can lawfully be limited, our total liability relating to a product will not exceed the amount you paid for that product. These limits do not apply where the law prohibits them or to liability that cannot legally be excluded or limited.

14. Indemnification

To the extent the law permits, you agree to hold Rialess harmless from third-party claims, losses and reasonable costs that arise directly from your unlawful misuse of the website or your material breach of these Terms.

15. Suspension and termination

We may suspend or end your access if we reasonably believe you have materially breached these Terms, used the website unlawfully or fraudulently, or created a security risk. Provisions that by their nature should continue after termination, including intellectual property, disclaimers, limits of liability, indemnification and governing law, will stay in effect.

16. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to any consumer right that cannot be waived, disputes may be brought in a court of competent jurisdiction in Travis County, Texas.

17. General terms

If any part of these Terms is found to be invalid or unenforceable, it will be applied to the greatest extent allowed and the rest will remain in force. Our failing to enforce a provision is not a waiver of it. These Terms, together with the policies and order details they incorporate, are the entire agreement between you and Rialess about use of the website and purchases. You may not transfer your rights or obligations under these Terms without our written consent; we may transfer ours in connection with a merger, reorganization, financing, asset sale or transfer of the business, subject to applicable law. Headings are for convenience only.

18. Privacy

Our Privacy Policy explains how we collect, use, share and protect personal information, including how we use cookies and similar technologies.

19. Changes to these Terms

We may update these Terms for operational, legal or regulatory reasons. The revised version will be posted on this page with a new “Last updated” date and will apply from then on, unless the law requires otherwise.
